CONNECTICUT PERSONAL INJURY LAW
Connecticut follows a comparative-negligence system for negligence claims. An injured person may still recover damages when their share of negligence is not greater than the combined negligence of the person or persons from whom recovery is sought. Any economic and noneconomic damages awarded are reduced according to the injured person’s percentage of negligence. If the injured person’s negligence is greater than the combined negligence of those against whom recovery is sought, recovery may be barred.
Connecticut law provides that many actions for personal injury caused by negligence must be brought within two years from the date the injury is first sustained or discovered, or reasonably should have been discovered. The statute also contains an outside limit of three years from the negligent act or omission. Different claims and circumstances can involve different deadlines or procedural requirements. Because missing an applicable deadline can prevent a claim from going forward, it is important to obtain advice about the specific facts of a case rather than relying only on a general website deadline.
